Vanguard SEC Fair Fund

A proposed SEC distribution plan for investors harmed by tax consequences associated with certain Vanguard target retirement funds; the plan is not yet approved.

You may qualify if:

The proposed plan covers investors who held the twelve listed Vanguard target retirement funds in non-tax-advantaged (taxable) accounts and were allocated excess capital gains by those funds on December 30, 2021, accrued during the January 1 to December 28, 2021 relevant period, and who have a recognized loss under the plan's methodology. Excluded parties include Vanguard, its present and former officers and directors and their close relatives and controlled entities, certain terminated employees, persons criminally charged in connection with the conduct, the fund administrator and its staff, anyone who purchased another person's right to recover, and anyone who does not timely return the required Certification Form.

Potential benefitUnder the proposed plan, if the net Fair Fund covers all recognized losses each eligible claimant is paid their full recognized loss plus any reasonable interest; only if the fund falls short is payment reduced to a pro rata share. Payment is capped at recognized loss minus any compensation already received from another source, such as a class action settlement. Calculated amounts below $25 are paid nothing at all and are reallocated to others. Nothing is approved: the SEC's deadline to approve or disapprove the plan runs to February 26, 2027.View field evidence
Documentation or noticeUnder the proposed plan the SEC identifies preliminary claimants from records, so there is no public claim form. However, a recipient must still complete, sign and return a Certification Form, with any requested tax forms or trade data, within 60 days of the mailed Plan Notice. Anyone who does not return it is treated as an Unresponsive Preliminary Claimant and is not eligible for payment. No Plan Notice has been mailed yet.View field evidence
